Government Clearance

In India, operating a factory or engaging in manufacturing activities requires obtaining a factory license.  A factory license is a document that permits authorities to carry out manufacturing activity. The Department of Factories and Boilers issues factory Licenses. The specific requirements and procedures for obtaining a factory license may vary based on the state or union territory where the factory is located. 
However, the general framework for obtaining a factory license in India is the following:

●    Factory Registration- The first step is to register the factory under the Factories Act, of 1948. This act applies to factories engaged in specified manufacturing processes with a minimum number of workers. The registration is typically done with the Chief Inspector of Factories or the designated authority in the respective state. ●    Factory Plan Approval- After registration, you need to submit a factory plan for approval. Make sure the plan adheres to the guidelines laid by the department and ensure the safety and welfare of workers. The plan includes details such as the layout of the factory premises, machinery and equipment placement, safety measures, and compliance with building and fire safety codes. The factory plan is usually reviewed and approved by the Factory Inspectorate or the State Industrial Safety and Health Department.

●    Safety Measures and Compliance- Compliance with safety measures and regulations is crucial for obtaining a factory license. This includes ensuring proper ventilation, lighting, sanitation facilities, fire safety equipment, emergency exits, and first aid provisions. The factory premises must adhere to safety guidelines and standards set by the respective state authorities.

●    Environmental Clearances-Depending on the nature of manufacturing activities and the potential environmental impact, you may need to obtain environmental clearances from the State Pollution Control Board. These clearances ensure compliance with environmental regulations and address pollution control measures.

●    Inspection and Compliance Audit- Factory inspectors or designated officials conduct inspections to verify compliance with factory laws and regulations. They assess factors such as safety measures, machinery maintenance, working conditions, employee welfare, and adherence to labour laws. Compliance audits may also be conducted periodically to ensure ongoing adherence to safety and labour standards. 

●    Renewal and Renewal Fees- Factory licenses are typically issued for a specific period and need to be renewed periodically. Renewal procedures and fees vary by state, and it is essential to renew the license before it expires to continue operating the factory legally. 

●    Approval from the Department of Labour-  After registering in the Factories Act, of 1948, factories need to seek approval for boilers and register in the principal employer's establishment under the provision of The Contracts Labour (Regulation and Abolition) Act, 1970. Contractors need to obtain a licence under the provision of The Contracts Labour (Regulation and Abolition) Act, of 1970. Factories need two more registrations under the Inter-State Migrant Workmen (RE/CS) Act, 1979 and The Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996 to operate in India 

●    Approval from the Department of Stamp and Registration- Factories need to register the property and seek approval from the department. 
●    Pollution Control Board- Factories need consent to establish Under the Air and Water Act (NOC), Operate under the Air (Prevention and Control of Pollution) Act, 1981, Operate under the Water (Prevention and Control of Pollution) Act, 1974, and Authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. 
Other departments from which factories need to seek approval are as follows-

●    State Fire Services Department- NOC from Fire Department (prior to commencement of construction activities) or Provisional.
●    State Power Corporation- Activation of Power Connection
●    Forest and Wildlife Department- NOC for Tree Felling
●    Union MSME Ministry- Udyog Aadhaar (MSME)
●    Public Works Department- Road Cutting Permissions
●    Directorate of Electrical Safety- Initial Inspection of High / Extra High Voltage Installation
●    Infrastructure and Industrial Development Authority- Building Plan Approval
●    Central Ground Water Board- Activation of Water Connection
